In addition to having a living will, each person should discuss their end-of-life choices with family members to avoid objections later on.
A medical power of attorney, also called a health care proxy or durable power of attorney for health care, is a legal document that names a person who can make medical decisions if a person is incapacitated. Unless you have designated someone to make these decisions for you by executing a durable power of attorney for health care, your health care provider may turn to some relative to make these decisions that you may not have otherwise chosen. For those who want to ensure that the person closest to them is the one making medical decisions, a health care proxy is essential for naming who will make medical decisions in a time of crisis.
A financial power of attorney is important to designate who will be in charge of financial matters in case of medical emergencies or incapacitating illness. Persons without a financial power of attorney will be at the mercy of the court to appoint a guardian. Courts may consider some relative to be first in line to take over your finances, even if you would have made a very different choice.
